Music and Copyright – Copyright on YouTube


Hi, I’m Michelle,
here to answer your copyright questions. Today’s topic is Music and Copyright. I played, sang
or whistled the song entirely by myself and didn’t use
a single second of the recording. Why did I still get a copyright strike? There are two distinct copyrights in music. Most people are familiar with the one
for the artist or band who recorded the song but there is a second set of copyrights
for the lyrics and melody also known as the composition
or publishing rights. When you sing, hum
or play a song on an instrument even if it’s in an entirely original way,
you’re using the copyrighted melody or words. If you use all
or even just a small part of a song you may receive a copyright strike
or Content ID claim. But keep in mind that most composition claims
are eligible for revenue sharing for creators in the YouTube Partner Programme. If you’re eligible you’ll be offered the option
to share the revenue of that video by confirming the video is a cover. I keep hearing about Content ID claims
where the song isn’t even there. What is YouTube doing about that? At its heart, Content ID is
what’s known as a matching system and it faces all the challenges
and limitations all matching systems face. Sometimes the system
can make a totally incorrect match like claiming someone’s video
where they’re doing a simple microphone test or even white noise. In these cases,
YouTube engineers immediately go to work to diagnose and fix the problems. In other cases entirely different original songs
can match parts of each other because they use the same beat track. We’re constantly working
to find solutions to avoid problems like these but we also understand that
no automated system will ever be perfect. This is why the dispute process
is an essential part of Content ID. As a creator, you have the most knowledge
about the content in your videos and how it was used so we built the dispute process to empower you
to escalate problems to the claimant and even escalate
as far as the courts if needed. If both you and the claimant are attempting
to monetise the video under dispute we will continue to monetise your video and will release the accrued earnings
to the appropriate party once the dispute is resolved. What rights do I need to buy
to use a song in my video? To properly use a song in a video,
typically you need an official music licence. These grant you the rights to use a song but be sure to read these licences carefully. Licences typically contain
explicit permission for using the content but may include limitations on exclusivity,
duration, geography or other terms. You should seek legal advice
for any licensing agreements. Although YouTube can’t
help you get these licences we can help you find music
that you can use in your videos. Our YouTube Audio Library is a great way to
find free background music or sound effects. There are also third-party services that
allow you to purchase music for your videos that won’t result in claims. Why are music publishers
enforcing copyright on YouTube but not anywhere else? Music publishers administer rights
on behalf of songwriters and provide an important service in allowing songwriters
to profit from what they create. In fact, music publishing rights are enforced almost anywhere music is performed,
streamed or otherwise transmitted and not just on YouTube.>From music playing on the radio

    How can you avoid copyright strikes when filming in public places where there is music just playing in the background? I do a lot of filming in amusement parks of the roller coasters, but often those parks will have music playing in the background over their speakers – I can't avoid the recording picking up the background music, but editing copyright-free music over the top of the recording loses the original sound of the roller coaster and the riders screaming etc. It's a real pain, but I can't think of any obvious solution. Any ideas? Thanks.

    No, YouTube, your dispute process does not "empower" me when it's the claimant who is judge and jury. Anyone can claim to own content in my videos, I can say "no, and here's why" and they can say "too bad" and block my video, make $$$ off of my work, or take my channel down entirely. You need to do better.

    I've received a lot of incorrect Content ID claims – for example, being told that my content belongs to another YouTuber who just happened to stream the same video game I did. Or, just recently, having someone claim I used a piece of music in my videos that I didn't actually use (disputed, got denied by the claimant, but if I appeal I risk losing my channel so… THAT'S not an option, thanks). How am I supposed to let your "YouTube engineers" mentioned at 1:20 know about stuff like this? There's no way to say "I think the Content ID system made a mistake" in your dispute process.

    Hello youtube I am a music producer and song writer and my straight forward question is that when I upload my music to youtube and same file to SoundCloud , my song on SoundCloud sounds the same as I produced but after processing on YouTube it sounds extremely dull and not what I produced. I do a lot of hard work on compression, eq and other tiny adjustment but all of that becomes wastage of time after my song is processed by youtube as it degrades the sound. Sucks the punch out of vocals and introduce a lot of artifacts in my song. Is this happening to me because my channel is small and youtube don't want small channels to compete with the big ones. Other professional tracks has more loudness in terms of LUFS and also have true peak above 0db but even after that they sound good on YouTube but my tracks sound trash. Why are you doing this to me, please stop doing this and stop the bad processing on my songs. Please

    I understand if I play their whole song in high quality. But when my 26 minute video has 19 seconds of a song being played across a room on a small stereo in the background with people in the video dancing to it gets "claimed" I say they are stupid fools. My clip is no substitute for their song that is on YouTube for free anyway, which anyone can record for themselves with basic software. All they are doing is making sure I don't give them a scrap of free publicity to my viewers, who may hear the clip, and want to seek that song out for themselves, ultimately resulting in revenue for them. Talk about cutting off their nose to spite their face….

    All you have to do is have a you tube red setup so people like me that have music they like to stream for their viewers i have on my live work stream. I would be happy to pay $9.95 a month to be able to stream all the FREE music i captured from you tube in the first place on you tube on my live stream. Then you get more profit and the artist gets paid its that simple! its a win win. You need to have that for us I all ready pay for you tube red

    what about other website that provide you free music for your Youtube videos like BENSOUND . They give you permission to use there music in your videos as long as you give them credit in description. Also like Free BAckground Music Youtube channel . They also allowed you to use there music . Is that a good way for new Youtubers ?

    now I realise I shouldn't be uploading others content without asking them, personally though I think if u upload a song and advertise all the others on iTunes or Amazon this is beneficial and the artists record labels loss that's just my opinion and understand & respect the rightful owners

    This is S.Rajeswari, and I am #Carnatic #Music Teacher. I am uploading/sharing my Carnatic Music Classed videos on YouTube.

    Recently I started getting Composition Claim for my Carnatic Music Class Video on YouTube…

    Some channels started claiming by saying it as "Composition Claim" with content that is owned or licensed by them("ChannelName").

    I don't know how such claims are allowed in YouTube, because, as I completed Diploma in Carnatic Music, with Sangeetha Bhushan as titled/certified from Tamil Nadu Annamalai University/College.

    So what ever I have learned from my College, I am teaching that and taking that as a video and sharing that in YouTube, how other channels can claim that as there own content with Composition Claim?

    The main author of Carnatic Music is Purandara Dasa (1484–1564) is referred to as the Pitamaha (the father or grandfather) of Carnatic music as he formulated the basic lessons in teaching Carnatic music, and in honour of his significant contribution to Carnatic music.

    So, how some channel can say it as there own content or composition?

    Is this Claim Valid or Not? Can anyone suggest?

    When I uploaded my video, there was no copyright on the music. But after 2 months of uploading I got a mail that the music I used is copyright. However I didn’t got any strike.What should I do now?

    You can use NCS, Vlog no copyright , audio library. You just have to copy paste the artist and name of the song along with the link to their youtube page. The creators that I mentioned make it easy for you to give them credit by putting all the information down in the comment section for you to add to your comment section. This is a good place to start for beginner YouTubers that don't have the money to pay for a licence copy. I find the YouTube free audio library selection a bit on the boring side.

    I create my own music using Logic Pro on the Mac. The amount of times I’ve had content claim thrown at me concerns me as I put a lot of time and effort into creating my original music only to be told someone else owns the rights to it and if I don’t take it down I’ll receive strikes against my name etc. I tried standing my ground once only to be threatened by action from the person claiming it was theirs. I backed off for fear of someone adding a strike to my account but still annoyed to this day as it was my own music creation and sounded nothing like the song I was being accused of using. Every time I upload a video with my music it’s a worry I don’t need.

    Good Q&A session. I watched it to the end. And just like in the other videos, you failed to address my question. Example: I am visiting Las Vegas. At night I go to the Bellagio Hotel water show and take video of the fountains. The Bellagio plays background music as part of the show. I posted my video on youtube and got a copyright hit. Why? I must assume that the Bellagio paid the music creator to use their songs. So the music is paid for. I am unable to separate the music from the sound of the fountains and the crowd. So my only alternatives are to remove the video or replace it with some youtube free music that does not match the motion of the fountains. Or, no sound at all. The Bellagio paid to play the music so that we could hear it as we record the water show. Like some people have stated below, if this type of copyright hit is continued, then one can never record the street signs on the Las Vegas Strip since they belong to the Hotels. Also, one can not record people walking down the strip without getting a release from everyone you pass. In my case, the action of the Bellagio Hotel does place the associated music in the public domain.

    Please try to address this next time.

    Youtube robot said that I can use the part of the video but the revenue is going to the original owner or it is giving statistical data to the owner. This is fine with me but when the owner manually claim it we are being strike though YouTube said the original owner is allowing a part of their content in our video, we can use the video but can't monetize it. I hope YouTube would deal with this kind of scenario in a kind way since the original owners are too harsh striking our channel with all their might though we can simply remove or delete the video part upon their request. Thanks.

    Very insightful podcast; however as an artist are there any must have books that you have read and can recommend for artist and producers to research. I recently purchased Music Business And Law Dictionary https://www.amazon.com/dp/1793146284/ref=cm_sw_r_cp_api_i_hQRQDbA5BE8DP that I personally recommend myself as a must have, but now I’m looking for something that exposes the snakes in the grass. MBALD exposes events like Beyoncé vs. Feyonce “Trademark Infringement” case for cross referencing, but now I’m looking for something that can red flag bad characteristics in opportunist before enduring all the legal stuff. You’ll be amazed how many artist are suing or are being sued.

    Dear Youtube team my channel is under review approximatrley from two months but didn't get any Email for additional review… almost send feedback 500 times but no response do tweets almost 12 times but not get positive answer… it is clear that my all work is real but don't know why you are doing like this… i was thinking youtube is responsible organization please tell me if not solve my problem i will quit from youtube ..     so in my newest video i got a copy right because i have music and i got permishion for the Band leader himself form the Band- Surrender The Fall , lead singer Jared Cole and i still got a copy right from it. why?

    I got a copyright strike on a public domain video I put up and have no idea why. I'm not going to waste time disputing since I don't get revenue sharing but how can you get a strike on a public domain video. It's Dragnet. Maybe the "Dum da dum dum" music is copyright – I don't know.

    The copyright rules on YouTube are simply unfair. For those of us that review or react to songs and music videos we don't stand a chance. We work hard to provide informative and honest reviews and reactions and provide extremely entertaining content for the viewers and yet we do not reap the benefits because of these strict rules. Music publishers should look at videos like this as free promotion. It is not like we are just uploading their music for all to hear rather than buying the song. In these scenarios the publishers are not losing anything and only stand to gain. I wish YouTube would reconsider the rules surrounding use of music in reviews and reaction videos because we as content creators in this niche are a huge part of YouTube's success and we bring in a lot of traffic. We work extremely hard on the videos that we produce and it would be great if we could reap the rewards and actually make a substantial living out of this without having to branch out through other revenue streams. Thank you

    If I make someone's music video one hour long would I have to include all the same credits that channel used in their description? I was going to make "Revenge" – A Minecraft Parody of Usher's DJ Got Us Fallin' In Love (Music Video) by CaptainSparklez but didn't know if I had to include the same credits he used.

    I am mystified by somerhing. If merely humming a song is a breach of copyright, how do cover versions of songs ever get released?- and there are thousands of them. Do the artists making the cover version ask permission of the song's composer? Also, I see they're trumpeting their wonderful audio library again in this video- I've had a Content ID claim for music I've downloaded from there. When I queried it, YouTube's terse reply basically said "hard luck". My advice is avoid using any music in videos uploaded to YouTube wherever possible.

    No music on this video because finding copyright free tracks that don't suck is still impossible. I personally use the Monstercat creators license. It's rather expensive but comes with access to almost all of their library and artists and tracks and I have been able to use it for years. It's also extremely well integrated into YouTube to where if you have existing copyright claims (like from using the Rocket League Soundtrack which didn't flag for a very long time but now does) then you can go clear them one by one using a tool on their website and they go away instantly and you can also get your channel white listed so those don't happen again. It's the best quality music as well as the best quality experience for YouTube creators so I highly recommend it. It's about $200 a year so it just depends on your margins off your channel and how important music is for your videos. Hope this helps a few people and chuck a like so someone else sees it.

    YouTube Team, Please do not condescend to 'educate' musicians on music copyright. The ones you ought to be educating are the companies you empower to make fraudulent claims and to collect money that does not belong to them. This matter is very simple: Companies who claim copyright on music that was written by composers who died over 70 years before the upload date are fraudulently collecting money on music that is in the public domain. At the latest, music becomes public domain (copyright no longer applies) after 31 December of the 70th year after the composer's death. These are the facts. And yet because of your broken/corrupt system, I was constantly inundated by fraudulent claims of 'copyright' on my own performances of my own transcriptions of music that has been in the public domain for centuries. And consequently (because I did not submit to this corruption but challenged it) monetization has been deactivated on my channel! And no human being ever responds to say why or to admit your automated error and remonetize my videos. No, it is not users like myself who need to be educated on copyright law; it is you, YouTube, and your corrupt corporate partners who you allow to make fraudulent claims of copyright on music that is in the public domain. Shame on You(Tube)!

    Really thank you for Advice and link. link article saying "This means you upload content from multiple sources, or that you reupload or repurpose someone else’s existing content"

    I did't reupload or repurpose another persons videos or content. My videos 100% created by me(no team-only me). These are all fight videos recorded by my pc screen. I have placed my logo with my all videos. Now I've seen more mugen channel videos. Most channels do not use their logos. Each Mugan channel often uses the same fighting characters to create their videos. This all channel has used small description to their videos(same to me). but problem- my monetization closed again again 4 times .(monetization problem only with me. Why?)

    please can you kindly advice me. if i did't reupload or repurpose another persons videos or content – what i doing for my videos. how i get a idea, how many videos must i delete? What is that video? how many videos must change context.? please kindly reply me.

    There's a free production track I've been using as the unofficial official theme music for the main character of my channel since 2007, but in the last year, on two different occasions, that track has been claimed by two different third-party policing companies. Both times I disputed the claims, but only one was successfully removed, while the other dispute was rejected. Again, this is a track of production music that was composed specifically for free use, there's no reason why it should be claimed by any third-party company at all.

    If you know no automated system is going to be perfect, then you need to acknowledge human beings are not perfect either so to strike them immediately without any sort of warning system is just vile and malicious.
